1. Overview
EasyPod respects the intellectual property rights of others and expects all users of the Platform to do the same. This Intellectual Property Policy ("IP Policy") outlines how we handle intellectual property matters, including copyright and trademark infringement claims, and establishes our procedures for reporting and resolving disputes.
2. Platform Role
EasyPod is a technology platform that facilitates connections between dealers, sellers, and suppliers. It is important to understand that:
- EasyPod does not create, design, or manufacture any products or designs on the Platform.
- EasyPod does not pre-screen, verify, or approve the intellectual property status of User Content.
- All designs, images, artwork, and materials uploaded to the Platform are the sole responsibility of the user who uploads them.
- EasyPod acts in good faith as a neutral intermediary and will respond to valid intellectual property complaints in accordance with this policy.
3. User Obligations
By using the Platform, every user acknowledges and agrees that:
- They will only upload content they own, created, or have proper authorization/license to use.
- They are fully and solely responsible for ensuring their content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property right of any third party.
- They accept all legal liability and financial responsibility for any IP infringement arising from their uploaded content.
- They will not use the Platform to reproduce, distribute, or sell counterfeit goods or unauthorized copies of protected works.

- Notify: Notify the user who uploaded the content about the complaint and the action taken.
- Document: Record the incident for our repeat infringer tracking.
6. Counter-Notification
If you believe your content was removed in error or that you have proper authorization to use the material, you may submit a counter-notification including:
- Your full name, address, phone number, and email address.
- Identification of the material that was removed and its previous location on the Platform.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

7. Repeat Infringer Policy
EasyPod maintains a strict repeat infringer policy:
- First offense: The infringing content is removed and the user receives a formal warning.
- Second offense: The infringing content is removed, a second warning is issued, and the user's account may be temporarily restricted.
- Third offense: The user's account will be permanently terminated.
EasyPod reserves the right to terminate any account at any time if, in its sole discretion, the infringement is particularly egregious, regardless of the number of prior offenses.
8. Disclaimer of Liability
EasyPod does not guarantee that all content on the Platform is free from intellectual property infringement. Users acknowledge that EasyPod is not responsible for monitoring, reviewing, or verifying the intellectual property status of User Content. The uploading user bears all responsibility and liability for any intellectual property infringement. EasyPod shall not be held liable for any damages, losses, or legal claims arising from User Content that infringes third-party intellectual property rights.
9. Indemnification
Users who upload content agree to indemnify, defend, and hold harmless EasyPod and its affiliates, officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising out of or related to intellectual property infringement by their uploaded content.
